Terms and Conditions for The Superyacht Club Pty Ltd Day Charter Events

1. General
The following terms and conditions govern the use of The Superyacht Club's superyacht ("the Yacht") for the day charter.
By participating in the charter, all participants agree to adhere to these terms and conditions.

2. Liability
The Superyacht Club shall not be liable for any damage to the Yacht caused by the negligence or misconduct of the charter participants.
Participants are responsible for any damage they cause to the Yacht or its amenities during the charter.

3. Indemnity
a. The Charterer agrees to indemnify and hold harmless The Superyacht Club, its servants, agents, and subcontractors against any and all losses, claims, actions, costs (including legal costs), expenses, fees, damages, and liabilities which The Superyacht Club may sustain or incur resulting from:
i. Any negligent act by the Charterer or members of the Charter Group;
ii. Any damage, loss, or theft of any property belonging to the Charterer or Charter Group arising from the Charter; and
iii. Any personal injury or death caused or contributed to by any negligent, reckless, or wilful act or omission of the Charterer or Charter Group.
b. The Charterer agrees to indemnify and hold harmless The Superyacht Club, its agents, and employees, from and against any and all losses, claims, actions, costs (including legal costs), expenses, fees, damages, and liabilities which The Superyacht Club may sustain or incur as a result of anything other than those listed above.

4. Personal Belongings
The Superyacht Club is not responsible for any loss or theft of personal belongings, valuables, or any items left onboard during or after the charter.

5. Safety and Water Activities
Participation in water activities such as swimming, kayaking, slides, and jumping from the Yacht ("Water Activities") is entirely at the participant's own risk.
Participants must organise their own health insurance cover specifically for participating in Water Activities and the day yacht charter.
The Superyacht Club is not responsible for any search and rescue costs that may arise as a result of a participant falling overboard or requiring rescue during Water Activities.

6. Alcohol and Conduct
Participants must adhere to responsible drinking practices while aboard the Yacht.
The Superyacht Club reserves the right to refuse service of alcohol to any participant who appears intoxicated or is behaving irresponsibly.

7. Shoes off Policy
Participants are required to remove their shoes before boarding the Yacht to help maintain cleanliness and prevent damage to the Yacht's interior.

8. Medical Conditions and Fitness
Participants with any medical conditions or physical limitations that may affect their ability to participate in Water Activities must inform The Superyacht Club prior to the charter.

9. Weather
a. Cancellation by The Superyacht Club for inclement weather, safety, or any other reason is at the Master’s discretion. In the unlikely event of cancellation, alternative dates suitable to both parties will be offered.
b. If the weather conditions are deemed dangerous for boating by the Master and The Superyacht Club, The Superyacht Club will use all reasonable endeavours to postpone and reschedule the Charter to a suitable alternative date. Rescheduled charters must be used within 6 months of the original Charter Period.

10. Indemnification
Participants agree to indemnify and hold harmless The Superyacht Club, its affiliates, and its employees from any claims, damages, liabilities, and expenses arising out of or in connection with their participation in the charter and any related activities.

11. Photography and Media
The Superyacht Club reserves the right to photograph or record the charter for promotional purposes. Participants consent to the use of their likeness in such materials.

12. Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Australia.

13. Acceptance
By participating in the charter, participants acknowledge that they have read, understood, and agree to abide by these terms and conditions.
